Terms of Service

1. Acceptance of Terms
By downloading, installing, or using Packd ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legal agreement between you and Michelle Gemmeke ("we", "us", or "our"), an individual developer based in the Netherlands.
2. Description of Service
Packd is a travel packing list app for iPhone that allows you to create and manage packing lists, share them with others via iCloud, and organise items by category, owner, and status. The App also includes the ability to submit feedback and report problems directly from within the app.
The App is available as follows:
- Free: Access to one packing list.
- Additional lists: You can unlock extra packing lists through one-time in-app purchases.
- Packd Pro (lifetime unlock): A one-time purchase that unlocks unlimited packing lists and all premium features, including list duplication and CSV import/export.
3. Purchases and Payment
Packd offers one-time in-app purchases through Apple's App Store: you can unlock additional packing lists individually, or buy a lifetime unlock that grants unlimited lists and all premium features. There is no recurring subscription. By making a purchase, you agree to the following:
- Payment is charged to your Apple ID account at the time of purchase confirmation.
- In-app purchases in Packd are one-time charges and do not auto-renew.
- Pricing is shown at the point of purchase and may vary by country based on Apple's pricing tiers.
- The lifetime unlock and any additional list unlocks can be restored on your devices via Restore Purchases in the App, as long as you use the same Apple ID.
If you previously held the legacy monthly subscription, your access has been converted to the lifetime unlock at no additional cost, and you will not be charged again.
Refunds
All payments for Packd are processed by Apple through the App Store. We do not have access to your payment details and cannot issue refunds directly.
To request a refund, please use Apple's official refund process at reportaproblem.apple.com, where you can view your purchase history and request a refund for an eligible item.
Refunds are granted at Apple's sole discretion in accordance with the App Store Terms and Conditions.
4. Acceptable Use
You agree not to use Packd in any way that:
- Violates any applicable law or regulation;
- Infringes on the rights of any third party, including intellectual property rights;
- Attempts to reverse-engineer, decompile, or otherwise derive the source code of the App;
- Involves scraping, automated access, or any attempt to extract data from the App by technical means beyond normal use;
- Introduces malicious code, viruses, or other harmful components.
5. User Content
All content you create within Packd — including packing lists, item names, notes, and categories — belongs to you. We claim no ownership over your content.
Your content is stored in your personal iCloud account via Apple CloudKit. By choosing to share a list with another iCloud user, you grant that person access to view and edit that list within the App. You can revoke sharing at any time.
6. Intellectual Property
Packd, including its name, design, visual identity, and underlying code, is owned by Michelle Gemmeke and is protected by applicable intellectual property laws. All rights not expressly granted in these Terms are reserved.
You may not use the Packd name, logo, or any related branding without our prior written consent.
7. Account Suspension and Termination
We reserve the right to restrict or terminate your access to Packd if we determine, at our sole discretion, that you have violated these Terms. In the event of termination, your data remains in your iCloud account and is not deleted by us.
You may stop using the App at any time. Because Packd uses one-time purchases rather than subscriptions, there are no recurring charges to cancel.
8. Disclaimer of Warranties
Packd is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not warrant that the App will be error-free, uninterrupted, or free of security vulnerabilities.
We are not responsible for the availability or reliability of Apple's iCloud infrastructure, which Packd relies upon for data storage and sync.
9. Limitation of Liability
To the fullest extent permitted by applicable Dutch law, Michelle Gemmeke shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, Packd — including but not limited to loss of data, lost revenue, or loss of goodwill.
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you have paid us in the three months preceding the claim.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will provide additional notice (for example, via App Store release notes). Your continued use of Packd after changes take effect constitutes your acceptance of the revised Terms.
